For centuries — literally for centuries — governments have been trying to find a alternative to prisons. Prisons traditionally fill three functions. They punish (aka provide justice), they rehabilitate, and they separate the criminal from potential victims.
Prisons are expensive. There is some satisfaction in seeing a criminal made to pay the price for his crimes, but from the POV of the modern state, punishment is the least supportable of its functions.
To get back to my original point, the current craze for keeping criminals OUT of prison isn’t new. It’s been done before, and failed before, for the same reason: some people are so bad that they need to be forcibly isolated to keep them from victimizing the innocent. Until Walz and Ellison and pretty much every metro area judge admit this, you are not going to see any improvement in the crime rate. At some point you have to put people in jail, even if those criminals belong to a “historically oppressed minority.”
The historically oppressed minorities are the ones who bear the brunt of violent criminals still being on the street instead of locked away.
