Correction

A spokesman from the Gun Owners Civil Rights Alliance responds to Joe Doakes’ piece this morning.

The letter from GOCRA follows, with added text bolded by me:

Doakes is referring to the modifications to 518B.01 on page 4.

At 4.16, you can see the existing language:

4.16 Subd. 6. Relief by court. (a) Upon notice and hearing, the court may provide
4.17 relief as follows:

and at 6.16, in the same subdivision, here’s where the new language starts:

6.16 (g) An order granting relief shall prohibit the abusing party from possessing firearms
6.17 for the length the order is in effect if the order (1) restrains the abusing party from

Due process is preserved.

In the chaos of this past few weeks, I’d missed the final version of the bill. 

It’s not perfect – but as the spokesperson says, due process is preserved.  And in a session where the only thing that separates “good” laws from “bans on magazines over seven rounds” is canny and tenacious negotiation rather than slogineering in pursuit of prinicple, it’s really the better of many possible endings.

  2. No, it’s worse than that: I’m not only corrected, I was wrong all along.

    The amendment applies to Section 6 (hearing after notice) but I mis-read the amendment to apply to both Section 6 and Section 7 (hearing without notice). My fear that Section 7 Orders could secretly strip firearms owners of weapons was unfounded.

    I apologize for crying wolf. GOCRA did a great job of damage control.

    Not exactly on topic, but sort of. A while back, when it was subzero and I was shoveling snow, I was able to get a clear signal and was enjoying your Sat. show. One of your guests was a candidate hoping to unseat Franken.

    He was pretty weak on the 2a issue and wouldn’t give a straight answer regarding the universal background check/ registration issue. “First we have to get rid of Franken” was pretty much all he’d say on the issue.

    Could you give his name? I was so put off that I spaced it out.
