We probably won’t get a perfect Justice under McCain and a Democrat congress, but with the oldest and feebliest judges being the most liberal, perhaps we can hope for a mediocre one, so overall will come out slightly ahead.

Of course there’s already a Republican majority on the court and the seats that are likely to come up, as Chuckwagon points out, are on the liberal end of the court. So Democrats will be much more successful in using the court to motivate its core voters than the Republicans will be. Yet another reason your guys are gonna get pantsed in November.
I wish there was a way the Republicans could do an advertising campaign on the 5-4 decisions. Showing how one justice makes a difference for decades in the future. There are a lot of families who support the Boy Scouts, for example, but don’t really follow politics and don’t know that an Obama court would have ruled against the BSA.
