Kennedy was the deciding vote — or, if you prefer, Alito was the deciding vote. Would O’Connor or Harriet Miers have voted the same way? If nothing else, Bush at least delivered this.

Remember this.

There’ll be a couple of SCOTUS seats coming open in the next administration.  And there will be cases just as important to liberty as Heller confronting the court.

  1. We probably won’t get a perfect Justice under McCain and a Democrat congress, but with the oldest and feebliest judges being the most liberal, perhaps we can hope for a mediocre one, so overall will come out slightly ahead.

    If the Messiah gets in there, well, that would be quite bad for the big court.

  2. You can bet your sweet bippy that Kerry would not have nominated someone like Alito or Roberts, and would have nominated someone like Souter, Breyer or Stevens.

    If nothing else, THIS is the reason I shall once again hold my nose and vote Republican for the 4th presidential in a row. The two before that, I didn’t hold my nose.

  3. Of course there’s already a Republican majority on the court and the seats that are likely to come up, as Chuckwagon points out, are on the liberal end of the court. So Democrats will be much more successful in using the court to motivate its core voters than the Republicans will be. Yet another reason your guys are gonna get pantsed in November.

  4. I wish there was a way the Republicans could do an advertising campaign on the 5-4 decisions. Showing how one justice makes a difference for decades in the future. There are a lot of families who support the Boy Scouts, for example, but don’t really follow politics and don’t know that an Obama court would have ruled against the BSA.

  5. Ah, yes. Because those bigots in the BSA don’t want out-of-the-closet homosexuals taking groups of boys into the woods for a weekend camping trips.
