Nashville shooting – or at least, the purchase of the firearms – could have been prevented if people took mental health reporting seriously:

Under federal law, it is illegal for “any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person, including as a juvenile” who has “been adjudicated as a mental defective or has been committed to any mental institution at 16 years of age or older.”

“Mental defective” is a term you don’t hear often anymore, and some may find it offensive, but under federal law, it has a specific meaning: a finding by any court, board, commission, or other lawful authority that a person “is a danger to himself or to others; or lacks the mental capacity to contract or manage his own affairs,” as a result of “marked subnormal intelligence, or mental illness, incompetency, condition, or disease.”

The Nashville shooter was, indisputably, a danger to others, and that threat to others was almost certainly connected to her mental illness. The evidence was there for her to be declared legally mentally defective and barred from owning firearms. The shooter’s parents believed she should not be allowed to own a firearm, indicating the shooter had said or done things that made her parents believe she was a potential threat to herself or others. But no one acted upon those concerns, and no one reached out to police.

Tennessee does not have a “red flag” law that would allow police to seize the firearms of individuals that are at elevated risk of harming themselves or others. However, under Tennessee law, anyone who has been deemed “mental defective” cannot purchase a firearm in the first place.

How much of this was “fog of war” (from a mental health perspective), how much was bureaucratic inertia, and how much was unwillingness on officialdom and, most likely, the familiy’s part to piss of the increasingly militant trans lobby?

  1. Fox News Defamation Case Cleared for Trial

Quite a spectacle this week — Trump and now
    Dominion Voting Systems lawsuit against
Fox News goes to court. Reaping what has been sown, and nobody will go down quietly. With regards to what difference this will make to Fox Viewership — the answer is none whatsoever — their appetite for affirmation far outstrips their care for reality.

  2. Emery

I would think that you would be proud of all your credentials.

You’re not an expert if you don’t have the credentials!

You love to brag about your indicia of wealth and privilege, why not brag about your CV?
What colleges count you among their alum?
What bachelor degrees do you hold?
Where did you get your Masters?
Where did you get your JD?
Where did you get your PhD(s)?
Where did you get your MD, what internships did you complete?

Vlad is correct its time for you to prove yourself something other than a mountebank.

  3. Talking point delivered!
Fox is such a weird obsession with the OCD left. I never listened to Limbaugh & the last time I watched Fox Bill O’Reilly was the king of their lineup. So I am one of the 95.4% of Americans who don’t watch Fox. Emery’s obsession with a news network watched by 4.6% of the American public tells you a lot about his failing mental state.

  4. That was one of the most interesting things I saw when the Fox News texts were revealed in the Dominion trial. Not surprising they knew they were lying on air about Trump’s loss.

But I was very surprised to note the reason they were lying: they’re scared to death of Trump’s supporters. They were frightened to death the audience would get angry and go to OANN or Newsmax, who are more willing to lie and pretend Trump didn’t lose. But one also gets the impression that Fox, Pence, and the MAGA caucus are terrified of the physical violence Trump’s mob does.

Even Trump himself became scared of his own audience, when he told them to get vaccinated and they booed him. They were angry with the Trump who said “get vaccinated,” because he was contradicting himself, the earlier “don’t get vaccinated, take ivermectin or chloroquine” QAnon Trump. So he gave up saying it, even though Covid-19 was killing more of his own anti-vaxx voters than Democrats. Even Trump doesn’t quite command his own cult. That probably wasn’t fear of violence, just Trump’s fear of ostracism by his own fans; but still, interesting. He fears them and is led by them.

TV shows like BrainDead or The Last of Us are terrifying, but at least the outer-space ants or evil fungus, which take over people’s brains in those shows, have a consciousness and are directing things. But the Republicans who are following their conspiracy theorists are following the followers. This seems very unpredictable.

In the minds of clueless out of touch Emery all people who don’t have MSNBC & CNN always on in the background MUST by default always have FOX on in the background. What the minds of emery can’t grasp is that the people they loathe, unlike themselves, are usually too busy being creators(building things, making things happen, etc), they have families, friends, and faith – they have no time to indulge FOX or any other media outlet

Emery doesn’t know or understand the people he is trolling.

  6. Actually I do — I seem to remember quite a large outcry here on SiTD regarding Stop The Steal. Votes were being switched by Dominion’s algorithm etc etc…

“This case is and always has been about the first amendment protections of the media’s absolute right to cover the news.” Fox News Corp

Exactly right. Unless, of course, you make the news up. In which case it’s not news. It’s lies.

  7. Just a reminder that Emery was wrong about the Brexit vote (Emery wrote that it would fail), wrong about The outcome of the 2016 election (Emery wrote here that Hillary would win over Trump in a landslide), and, of course, wrong about the outcome of the Mueller investigation (Emery still claims that Mueller found evidence that Trump colluded with Putin to steal the 2016 election from Hillary).
Emery is mad as a hatter.

  8. Interesting legal problem.

I claim your computer switched votes.
    You sue me for lying.
I assert truth is a defense.
To assist my defense, I demand to see the programming to prove your computer switched votes.
You hide the programming as proprietary information to avoid revealing that my claim is true and your computer actually did switch votes.

    Who is lying?
