A Guy With A Gun

Last week, an armed robber at a Taqueria in Houston, Texas got tuned up by a guy with a gun.

I desperately want to call him a “good guy with a gun“. pinky swear, I do. An armed robber f**ked around, and he found out.

Warning: not for the faint of heart. Somebody dies in this video.

Remember; to claim self-defense (and win a trial, if it comes to that), you have to show five things:

You are innocent (or not the aggressor)

You reasonably fear, death are great bodily harm

That threat is immediate.

you use only the force needed to end that threat.

It’s Texas, so there is no duty to retreat

My two cents worth:

  • The first four shots are perfectly good
  • Shots five through eight might be explainable, by a decent lawyer.
  • Shot number nine? Looks like an execution. AYou’re going to need a very good lawyer indeed.
  • Leaving the scene afterwards? Could be problematic.

This show – two self defense lawyers discussing the case – is two of the better hours. I’ve seen on the subject. It’s well worth a watch.

It’s a cautionary episode, indeed.

  1. Glad we all have more air to breath but this guy is going to be a lot poorer and in legal trouble.

  2. Yea, I actually think that he fired too many shots, especially when he shot him in the back. That last one though, really pissed me off. That kind of careless act is what the anti gun crowd will latch on to as a racist white guy killing a black man, making a martyr out of the thief.

  3. I watched the Law of Self Defense show, found it very informative. Boss, I should point out that an armed defender is under no obligation to wait for the perp to turn around or shoot first. Perfectly ok to drill him in the back. The last shot here however is going to cause problems because the defender had picked up the perp’s gun and the guy was defenseless. Probably dead already. Which might save him from a murder rap.

    Kind of like the murderer/rapist who tells the jury he killed his victim before he stuck his d*ck in her, so technically it wasn’t rape.

  5. I can assure you that if ever put into that situation that all my actions will be calm, controlled, reasonable and rational and that I, unlike most normal humans beings, will never let fear, anger or even adrenaline get the better of me.

    The last shot did bother me and I hope that justice will be served by this gentleman suffering the same legal consequences as the guy who shot Ashley Babbitt.

  6. every day in courtrooms and DA offices across the country progressive judges and attorneys release dirtbag barbarians from well deserved custody so that they may continue to prey upon citizens who wish to be law abiding.
    But the rule of law is dead!
    And that truth is obvious to even the casual observer when you see these barbarians repeatedly released with little or no consequences for their behavior. Indeed they are
    feted and treated as a preferred class and they will never be held to account for their crimes. Despite what jurists like Peter Cahill believe this is obvious to the general public. Most of that general public refuses to acknowledge that corruption because they do want to believe in the rule of law.
    But the rule of law is dead!
    That is what the shooter in this video understands so he put the barbarian down, made sure he would never get back up and chose (wisely) not to surrender himself to the tender mercies of a legal system intent upon victimizing him.
    Expect to see more of this as long as our legal system refuses to enforce the laws it is sworn to uphold. This is the beginning.

    The above Biden exec order is why the nation is beset with transportation problems while Buttagieg frets about freeways inconveniencing minorities. Buttagieg is doing exactly what Biden wants him to do.

    In one of my PTC classes we were told leaving the scene demonstrated a fear of reprisal by co-conspirators of the crime.

  12. The rule of law is dead – and so is the perp in this case. I’d hazard that more often than not, the thug is the one exercising “executive sanction”. The rule of law will only be applied to victims that shoot back.

  13. On a related note, an employee of a KFC restaurant in St. Louis, MO, was shot by a customer on December 12, after he became upset when he was informed that the restaurant was out of corn.

  14. Houston DA (Kim Ogg) is a Soros DA – this guy will probably be prosecuted. Texas jury will probably not convict, but that doesn’t matter. These days the punishment is the prosecution.

  15. More specifically, Harris County DA (Houston has many counties). Ogg had not met a felon she either did not arrest or let go without bail, no matter how heinous the crime. Other than shutting down and fining businesses that dared oppose the lockdowns. Them a REAL criminals, dontchaknow. Funny how we discuss the law as it pertains to defense, while actual perps go free. Law? What law? We don’t need no stinking law!

    the trial of officers Chauvin &Co by AG Ellison is the preferred model of a leftist prosecution. The prosecution builds a dream team of public and private attorneys who want to be DAs, Judges, or AUSAs themselves some day and they wallpaper the case and submerge the hearings in Expert testimonies thus impoverishing all but the wealthiest defendants, ruining their careers, marriages, etc. Because as has been pointed out, “the rule of law” is a fiction trotted out for the media, it doesn’t matter that much if the defendant is acquitted because he is probably homeless at this point and is a solid object lesson for any who question the Establishment.

  17. Well the shooter did do the right thing

    He left the scene, found himself a lawyer, and turned himself in to the local PD. The Soros DA is going to bring him before a Grand Jury to effect an indictment.

    He did the right thing by leaving so he wouldn’t make an emotional comment to the police before availing himself of counsel.

  20. It’s just been released that the dead thief, who was “shot dead by a vigilante in TX, had a long prior rap sheet”. At least his relatives can’t say; “He was such a good kid and was turning his life around.” Oh. Wait.

  21. I appreciated the comments from the relatives of the man who’d been killed ten years back by the deceased. “If the guy who sopped Eric had been around ten years ago, maybe I’d still have my dad.”

    Noticed in the other video that the perp was pointing a gun at another patron that I hadn’t noticed when I made my first comment. Hence I am walking that back. The perp was not safely exiting the restaurant yet, hence he had the right to shoot until the threat ended, and you can make a case that that includes the last shot. “I thought he moved”, and when you couple that with the stress of the situation and the obvious lethality of the previous shots, I think he skates.

    It’s worth noting as well that local authorities had released the deceased after only six years of a fifteen year sentence, and that for a very reduced crime–assault rather than a degree of manslaughter or murder. So in a way, the deceased’s death is due in great part to DAs, judges, and such who are soft on crime.

    Congratulations. You got the guy you thought you were helping….killed.

  23. The DA, Harris County DA Kim Ogg, is about half-woke. She is a limosuine liberal and a Democrat. She won her last election by a margin of 100k votes, about 56 to 44 percent.
    The robber is all too typical, had a long criminal history, including a conviction for armed robbery, and was out on bail when he was killed by the victim.
    But, yep, the US has an over incarceration problem.

    The Henco coroner issued a report that named Fentanyl poisoning as the cause of death, and the changed it under political pressure.

    That is not rule of law, that is mob rule.

    When a man cannot trust the government, or the police or the. Courts, he is left with but one option.

  25. Y’know, now that I am becoming an old reactionary, I am beginning to see the world through Peter Hitchen’s lens: most crime is a result of drug use and addiction. The people who believe that drug use & simple possession should be legalized (I think MBerg may be among them) are wrong if they think that this will reduce crime & ruined lives.
    Drugs are already cheap and easily available in the areas where drug use is highest. A dose of fentanyl or meth is cheaper than a six pack of beer.
    The problem is that for many drug addicts the dollar cost of a dose isn’t what drives their criminal activity, what drives their criminal activity is that being an addict makes it impossible for them to earn an honest living. Your drug habit may amount to $400/month, but keeping a roof over your head and food in fridge will cost you one or two thousand bucks each month & it’s impossible to make that much if you are strung out.
    Holding down even a low skilled job requires showing up on time & sober.
    Back in the 90s I knew a guy who worked construction. After a series of disasters, including divorce, he started on meth. He was making good money working, meth was cheap. But he stopped showing up for work. When he showed up one day, “ready to work,” wearing shorts and in stocking feet (he did concrete pours), with his girlfriend and her kids outside in the van he lived in, he was fired. The downward spiral continued & he went to prison for theft and threatening his ex wife’s boy friend.
    Hard to see how the criminalization of drug use led to his downfall.

One other note here is that the patrons are doing all they can to make any carry permit holders have a chance to off the guy–they throw their money on the floor so he has to bow down and lose tactical advantage. I would not be surprised if drugs were involved, because the guy literally lost his life over pocket change.

    I am getting to the point where I am going to start taking this (stuff) personally, as my niece, a lovely 23 year old until the drugs and tattoo parlor took over, was buried just before Christmas. Medical examiner’s report expected in 6-8 weeks, nice long time for any trail of evidence to grow cold. I don’t know at drugs killed her yet, but there are no obvious signs of trauma, and “widowmaker” heart conditions are pretty rare.

  27. On a bright note (other than one less vermin to soak up oxygen and CO2), national reciprocity bill had just been introduced. And fuck Ogg. Entire Harris county police force hates her, even the woke chief. Watch for Harris county judge election suit that was just filed. Soooo many irregularities it was a joke. Hope ogg gets snarled in it as well.
