Governor Fredo bans the sale and most display of “hate symbols” like confederate flags and swastikas in New York.

Because he can, that’s why.

I mean, there’s that pesky First Amendment and all..

But noted First Amendment lawyer Floyd Abrams argues Cuomo may have a larger problem on his hands, extending beyond a quick “technical” fix. 

“Governor Cuomo is correct that the First Amendment may require changes in the law in light of the First Amendment. A private entity can choose to sell or not sell offensive symbols but when the government bans the sale of offensive, but constitutionally protected symbols, on its property the First Amendment comes into play,” Abrams told The Post.

A Cuomo spokesman said the governor’s legal team will be reviewing the bill in consultation with the state Legislature to make a possible amendment.

If we only protected speech everyone agreed with, we wouldn’t need a First Amendment.

  1. When I saw that, my first thought was “flying the Southern Cross is a problem in New York? Really?”

    I guess I see it around here at times, in which case we might ask “why do people who have no ancestors who served in the Confederate Army fly the Confederate battle flag?” Of course, the left doesn’t want the answer to that, largely because they know–it’s not an endorsement of slavery or Jim Crow, but it’s rather it’s a way of flipping the bird at an overbearing government, of which the Democrats/left are the worst representatives.

    Plus, is it because I’m ESL, but was anyone else tortured by “Governor Cuomo is correct that the First Amendment may require changes in the law in light of the First Amendment.”? And that’s a quote from a lawyer?

  3. JPA: yes #2 on my part. It reminds me of the joke about the pathologist on the witness stand, being asked by an aggressive lawyer about how he knows a man is dead, but didn’t do an autopsy or anything. Answer: “His brain is in a jar on my desk. I suppose he could be out there practicing law or something, but ordinarily I’d conclude he’s dead.”

  4. The story also relates the news that Cuomo signed an order that supposedly forbids federal immigration agents from arresting illegal aliens while leaving court after being exonerated for whatever crime they committed to occasion there having been summoned there.

    So, while Cuomo stands ready to usurp Americans constitutional rights, he makes up for it by granting criminal non-citizens new ones.

    No wonder Sniffin’ Joe is said to be looking for a position suited to such talents. He’s going to need lots of dgaf attitude surrounding him.

  5. I know people who fly the Confederate flag around here in Wisconsin. They do it because it’s a big middle finger to the people who they want to piss off. Nothing more than that.

    I have a 5 ft x 8 ft American flag on a 25 ft flag pole in my front yard, and once Biden is installed as POTUS it will go down to half staff and stay there. If Biden is removed because of dementia and Harris is his replacement, I might be looking for a Confederate flag.

  7. There are 3 Confederate Battle Flags I know of that fly on illuminated, 80′ tall poles within sight of interstate highways. 1 in NC; 1 in Alabama and 1 in Georgia.

    There’s also 1 along I5 in Washington state…I particularly approve of that one.

    There’s a pretty substantial display of flags at the Dixie Republic Confederate superstore on hwy 26 in Travelers Rest, SC and along I20 near Talladega AL, advertising The Dixie Shop.

    Reprobate legislators in each of those states have tried several times to have these displays removed, but have failed because all are safely on private property.

    The mural on the wall of Cup foods in Minneapolis, commemorating a violent felon that died of a fentanyl overdose while in the commission of another felony is an abomination in my eyes. But as it is on private property, averting my eyes is my only recourse…for now.
