Shot in the Dark

Update

Joel Rosenberg got arrested yesterday while at Minneapolis City Hall.

The Strib has the story – relating the same story we did earlier (parts I, II and III) – and then yesterday’s “incidence”,  sort of:

On Wednesday, Rosenberg was booked into the county jail on charges of possession of a dangerous weapon in a courthouse, a felony, and contempt of court, a misdemeanor.

City Hall is part of the courthouse complex because it houses conciliation court on the third floor, the charges say. A sign posted in the hallway that connects City Hall with the county Government Center states that weapons are prohibited by district court order.

Rosenberg was being held in jail Wednesday night in lieu of $100,000 bail.

Rosenberg, of course, contents that the county’s “court order” barring guns in the hands of legally-permitted carriers from county courts conflicts with state law.

His court appearance is scheduled 1:30 this afternoon.

    If this is even remotely a just world, the DA and several members of the Minneapolis Police Department just effectively signed their resignation/termination papers.

    $100,000 bail? He’s a citizen, noted author, has a business and owns real estate in town, has family here, and local gadfly not to mention the most prominent firearms safety trainer in the state. In what fantasy world is he a flight risk?

    Does the Minneapolis City Attorney issue felony charges, or is that a County Attorney-level charge?

    Rosenbergs have some action pending against the city, I believe. Does this smell like the City raising the stakes by trumping up criminal sanctions to gain advantage in civil litigation?

    A warrant obtained a MONTH after the incident happened would tend to point to that conclusion.

    Yeah, I saw the $100,000 bail and want . . REALLY?!? I’m not discounting that Joel may have poked the monster here, but he is clearly not the type who is a danger to society or a flight risk for that matter. It is clear in the videos he was always courteous, respectable, and . . . . didn’t Palmer give him his gun back right away after taking it off him and told him to bring it back to his car ‘Please’, where it was greeted with a ‘You said the magic word’ by Joel.

    If the law is even remotely close to how they are interpreting it in the charges, that all goes out the window when Palmer gave him his gun back within the same area, Doesn’t it?

    Methinks Joel goes home today, and the lawyers will figure it out.

    Best of luck, Joel! Here’s hoping this becomes just another story you can tell me at the next MOB gathering.

    Uh, nate…we’re talking about Susan Segal here. Although, to be fair, she has shown that she is intelligent on accasion.

    Yeah, Palmer could’ve arrested him on the spot, without a warrant, but didn’t.

    He could’ve changed his mind about not arresting Rosenberg shortly after the incident, gone to a magestrate and got a warrant within a day or 2. But he didn’t.

    Instead, a warrant issued a month after the incident. Why so long?

    I’m not a fan of Rosenberg’s stunt here, but this smells.

    Sidenote, did anyone else watch ‘The Defenders’ last night. Just LOVE this show. But the main plot case was also on federal gun laws. Very interesting.

    More than a few of us actually know Joel, and if nothing else know he would’ve thought these matters through, as well as conferred at length with council about the legal aspects of any actions he considerred taking. He knows any number of the most highly regarded an acclaimed attorneys in the area.

    Mpls has written a TON of checks to compensate for some of the arrogant dumb-ass crap the MPD has pulled over the years. They well may be setting the city up for another round of check writing.

    Good luck to Joel. Even if he is 100% right he still has an uphill fight in MPLS. Hopefully he wins otherwise we will see the term courthouse applied to city parks, sidewalks, and streets within 10 miles of an actual courthouse.

    I like the charge of violating a court order he’d never heard of, personally. That would be a cross examination I’d pay to see.

    And given that Minnesota’s Supreme Court apparently cannot understand the plain language of our election laws, I agree that this could be an uphill fight.
