Shot in the Dark

This Is What Evil Looks Like

Man tries to rob parking lot attendant in New York. Shoots him twice. Attendant nonetheless takes the gun away, and shoots the attacker.

Police arrest the victim, charge him with illegal gun possession. For taking the gun used to try to kill him.

[Attendant Moussa Diarra, age 57] was shot twice during a tussle with suspected thief Charles Rhodie at Carolan’s West 31st Street garage early Saturday before using the accused man’s weapon to shoot him back.

Diarra was initially charged by cops in the case, including with criminal possession of a weapon for having Rhodie’s gun at one point, but Manhattan District Attorney Alvin Bragg’s office Sunday dropped the raps. Rhodie still faces charges including attempted murder.

Bragg’s office dropped the charges after public outcry.

Let’s emphasize that properly – it took public outcry to get these morally depraved charges against an innocent man who defended himself dropped.

And just so I’m clear, by “depraved” i mean “evil”.

When governments goal is to make people more afraid of the consequences of protecting themselves than of being victimized, there is no other word for it.

The most frightening aspect in my mind, is that the police actually filed the charges! Sorry, but when LEOs are more frightened about losing their pensions than delivering fair justice, that’s where they lose me. I’ve had discussions about this with family and friends that were LEOs and they totally understand. In fact, the wokeness and political weaponization that has infiltrated our law enforcement entities, actually encouraged three of them to retire as soon as they were eligible. Obviously, this is happening all over the country.

Why do malignant actors like Bragg thrive? Because in the world our Democrat friends are building for us there are only rewards for the bien pensant, there are no consequences. This is drilled into them from pre-school on, why should we expect anything else. Mr Bragg is the end product of that system. Think what Law Enforcement will be like in a couple decades after 20 years of TrannyFest™.

The nature of large language model (LLM) based AI is that it is centralized under a single authority. For some reason, unlike a human 8th grader, to communicate as well as an 8th grader, LLM’s need to be trained on billions and trillions of examples of human speech.
Whoever decides what “truth” these AI’s will communicate will be decided by the people who backed Bragg, with people like Bragg implementing the model.

You raise a lot of good points, Pig, but I don’t think of Bragg as an actor, malignant or not. I see him as a puppet for others.

When he started his reign, he was not all that interested in the process against Trump and as a consequence, two assistant DAs working that case resigned. So, he let the case continue… then remember last week when the indictment looked in danger of collapsing because the whole case was so weak? Then remember, how, outta the blue, the indictment was suddenly a thing? And here we are; multiple lawyers, both for *and* against Trump have expressed how weak the indictment is. I think Bragg was simply told to go ahead – or else.

Bragg also indicated right after starting that he is among those Mary Moriarty-like DAs. Because he was told to.

This post should focus on the two key questions rather than attacking the prosecutor.
    • Is what Trump is accused of a crime?
    • Did he do it?
Everything else — is arguing for a two tier justice system.

What colleges count you among their alum?

    What Has Chicago Done?
    Chicagoans cheered Mayor Lightfoot’s exit.

Gone was her toxic attitude. Her flippant dismissal of the city’s many crises. Her dismal record on crime. And her destruction of police morale.

She was an absolute failure by any measure.

From the beginning, she was more interested in imposing a progressive vision and an “equity” agenda on Chicago than enacting the many reforms the city needed.

So Chicagoans kicked out Lightfoot. Change was possible.

But what Chicagoans voted for on April 4 was someone more extreme and exactly opposite of what the city needed.

Yeah, not gonna feel bad about the consequences.

As a non-lawyer, it seems problematic that Bragg indictment is for crimes that are not crimes unless committed in furtherance of another crime, which Trump has never been prosecuted for.
So Bragg is assuming guilt that has never been proven.
Seems un-American, to say the least.
The biggest proof of the Dem F – up is the trial — if it gets that far, will take place in the primary season next year.

Unless Bragg is holding something back that won’t be revealed until the discovery process— I’m unimpressed with the indictment and statement of facts.

    As MBerg illustrates:
    • Unsurprisingly all the media is covering an unprecedented event in US political history. This is standard practice.
    • Trump has been accused of committing a large number of crimes and has been judged guilty or innocent in the court of public opinion based on partisan biases. So it is good that due process is being followed to determine the legal facts.
    • It is good that readership of traditional media grew in response to the fake news spun by the post-truth politicians.
    • Both sides of the political aisle are keen to understand Trumpism and its causes better and so the media is following the story closely.
    • Biden is sensibly keeping the power of the US Presidency out of a legal matter involving his likely opponent.

Unless and until the US and the global public lose interest in Trump, the media will keep covering him.

There is a beleif on the part of some Democrats & #nevertrumper republicans that the Bragg indictment serves Democrat purposes by giving Trump a boost that will carry Trump through the R primaries next year. The idea is that they want Trump to be the R nominee because Biden has already shown that he can beat Trump.
But I am reminded that the same sort of talk was flying around in 2016. Hillary would have an easier time beating Trump than someone like Cruz or Kasich.
Never forget that the Dems are just as f*cked up as the R’s. They have elite & institutional support the GOP does not, but they are dumb as a box of rocks. They literally believe that a woman can get a man pregnant. Seriously, just ask them. They think people can be convinced that poverty is a virtue. They believe that airplanes will continue to fly when engineers are taught that 2+2=4 is racist.

Emery, doesn’t it bother you that Bragg is prosecuting crime victims for self-defense, failing to prosecute real violent criminals, and spending his time on arcane financial dealings alleged to have something to do with an election, and after the statute of limitations has expired–all while not naming the most significant part of the crimes in the indictment?

Really, this is something that ought, in a sane world, to lead to disbarment for Alvin Bragg, and really prosecution for him. Monkeying around with people like he’s doing is a very real moral offense.

Found the answer about that taxes thing.
“The statement of facts [Manhattan District Attorney Alvin] Bragg filed along with the indictment makes a surprising claim,” and when Gerstein describes it as “surprising,” what I took away from it was “gob-smackingly stupid.” The problem, you see, is “that Trump and his associates engaged in deception by paying New York state more in taxes than it was owed.”

Trump cheated on his taxes by paying too much in taxes?

Trump has been a gift to the Democrats — not only has he turned off the traditional GOP base of the wealthy educated business class, but he has permanently run off an entire generation of young people from the GOP. He is the perfect boogeyman for Democrats to rally support around. With the GOP’s base now being “working class” blue collar whites; it’s hard to see the GOP turning this around anytime soon. Until we eject Trump, the damage will only get worse.

Having said all that, this indictment wreaks of political persecution and personal vendetta with a prosecution looking for (creating) a crime. You know it’s bad when so many legal experts (notoriously liberal) say it is flimsy. This sets a very bad precedent for our country and the battle will by highly divisive. And for what? A pretty small payment made to a blackmailing porn star? They are only legitimizing his grievances! That political capital should’ve been saved for the Georgia or Jan 6 cases.

Here is the New York statute Bragg is using to prosecute Trump:
A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.
You see the problem? It’s in the 2nd clause.
Trump has not been convicted of a crime.

  32. Emery Avatar

Even if the Federal election laws weren’t violated per se, expensing the payments as business expenditures was done with the intent to commit tax fraud, which is illegal at both the Federal and state levels. If Trump had just made the payments out of his own pocketbook and called it a day, he wouldn’t have been charged. Trump thought he could reduce his tax burden so he expensed them instead, hence the crime.

There is no legitimate basis for China’s claim of sovereignty over Taiwan, or that the territory of Taiwan belongs to mainland China. The Qing dynasty lost Taiwan to Japan in 1895, which in turn ceded control of Taiwan in the Treaty of San Francisco, which was Japan’s post-WWII peace treaty. Most notably, Japan did not cede control of Taiwan to another nation. Under the UN Charter, sovereignty in such cases defaults to self-determination. Taiwan has exercised their right to self-determination ever since and has enjoyed the most peaceful and prosperous period of its entire history. Taiwan is self-governed, with democratic institutions, free elections, its own military, constitution, trade agreements, and all the other elements of an independent country—and has for generations. Indeed, Taiwan was once recognized as a sovereign nation by the UN and most countries in the world at one time or another.

Andy McCarthy on the Trump indictment:
the indictment fails to say what the crime is. Bragg says he is charging Trump with felony falsification of records, under Section 175.10 of New York’s penal code. To establish that offense, Bragg must prove beyond a reasonable doubt that Trump caused a false entry to be made in his business records, and did so with an intent to defraud that specifically included trying to “commit another crime or aid or conceal the commission” of that other crime. Nowhere in the indictment does the grand jury specify what other crime Trump fraudulently endeavored to commit or conceal by falsifying his records.
