Wrong Solution, Wrong Problem

Senator Elizabeth Warren supports court-packing.  That’s really embarrassing for a Harvard law professor.  Even a night-school wonder like me, knows better. 

The problem with the Supreme Court is not that it’s too small. The court is too large now, to get things done expeditiously and correctly: too many egos to sooth, too many agendas to accommodate, too many compromises requiring hair-splitting decisions.

The problem is not that the court is full of justices eager to overturn precedent.  If a case was wrongly decided, it should be overturned in the interest of justice.    

The problem is not that the court veers away from widely held public opinion.  Pandering to public opinion is Congress’ job.  And it’s mostly on volatile social issues where the Court has caused the worst problems.

The problem is Marbury v. Madison, a case decided fewer than 20 years after the Constitution was adopted.  That’s the case in which the Supreme Court gave itself the power to throw out legislation the Court felt was incompatible with the Constitution.  The court’s power-grab flatly contradicts the entire premise of a “enumerated powers” Constitution.  That decision set up the Court to make historically and horrifically bad law:  Dred Scott (struck down the Missouri Compromise which allowed slavery to spread to more states), Plessy v. Fergussn (upheld racial segregation); Korematsu (upheld concentration camps for American citizens); Roe v. Wade (upheld abortion on demand); Obergefell v. Hodges (struck down gay marriage laws nationwide).   

Adding more justices to a run-away court won’t rein it in from ruling on social issues.  A constitutional amendment is required.  And if that doesn’t curb their enthusiasm, perhaps removal from office?  A Harvard law professor should understand that.

    Except, didn’t we already see this show? Remember the “Contract with America”? Yeah, we owned the reprobates that time, didn’t we?

    So, how is it we are ten times more fucked today than we were in 1994? Someone revived today from a ‘94 coma would go insane.

    Sure, “conservatives” are in good shape to take majorities in Congress…so fucking what?

    Will they pass legislation making illegal entry into the US a felony? Will they enact the “They must all go back” act? Will they free the men sitting in solitary confinement in DC jail, awaiting their trespassing trials? Will Hillary be tried for lying to Congress? Will Fauchi be held to account for lying to Congress?

    Will the federal government be purged of Communists and anti-White extremists? Will the FBI be washed clean? Will the NSA be stopped from collecting data on US citizens?

    Will tax dollars stop flowing to insane, leftist led Universities? Will teaching anti-White, anti-America propaganda like CRT be on the list for de-funding a public school?

    Will there be a reckoning for the trillions of dollars that have been funneled into leftist NGO coffers and private bank accounts?

    Will puberty blockers be banned? Will parents who gave them to children be jailed for their crimes?

    Lol, no. There’s a better chance the umbrella man will be identified than any of that.

    But yeah, sure. Bring on the mid-terms.

    MP, Trump was a real danger to the status quo. Yeah, all the Dems and (I say) 3/4 of the Repubs were in cahoots, because the enemy of my enemy is my friend.

    That’s why they are still in a rabid frenzy; while Trump draws breath, the danger remains.

    Say what you will about them, the leftists know how to finish a job, and the GOP is happy to help, like the hapless lap dogs they are…how many leftist Representatives lost committee assignments? How many were censured? You think that will happen when the Repubs take control? Lol, no.

    But in the end, it doesn’t matter. This experiment in Democracy has run it’s course. Anyone who doesn’t see and acknowledge it is a fool.

    The degenerate mob is in control, world wide, and won’t be stopped until it’s burned everything to the ground and salted it.

    I let that truth guide me, and I prepare calmly and deliberately to make sure my family survives CWII…I may not survive, but I really don’t gaf.

    kinlaw, it’s not the voting that matters, it’s the vote counting.

    Brandon and the Georgia senators didn’t win because they received the most votes. They won because the vote counters Said they received the most votes and then refused to let anybody look at the ballots to confirm it. Every court refused to look at the evidence to challenge it.

    This is not a new concept in politics – see the quote attributed to Lenin – it’s just new in Presidential elections. America has degenerated to the level of the Third World.

    Until this graph is satisfactorily explained, there’s no point in voting.

    I’m not saying that to depress turnout, I’m saying it because turnout doesn’t matter if the vote counters cheat. Losing by a million fake votes is the same as losing by one fake vote. It’s still losing.

    My take here is that Fauxcohontas’ statement is mostly “if we cannot win fair and square, we will rework the rules of the game until we win”, more or less a declaration of total political war.

    My thought about vote fraud with regards to this is that if we make that point to the electorate, Fauxcohontas may remain in the Senate because Massachusetts is pretty far gone, but her perspective will be seen by most of the country as an abomination.

    Well JD, quite a few states passed election integrity laws that would make it harder for libturds to cheat. And from what I have read, there is a record turnout by registered republicans to serve on election committees and as observers. So there is hope in THOSE states. MN, CA, NY, WA and a few others – not so much. Your vote will be suppressed and at best discarded, but not counted. Split the country, let the libturds reap what they are sewing and fester in the sewer of their own creation.

    I’m reading a book, “Murder at Teal’s Pond”, which is a true story of the murder of a young woman in upstate New York that ultimately inspired the Twin Peaks series. Anyway, the story takes place in the early 1900s, and part of the backdrop is the fervid political battles between the dominant Republicans and upstart Democrats in the region that even lead to a Republican poll-watcher being shot and killed, and a mostly innocent man (an associate of the actual shooter) being railroaded and executed. The more things change…
