Last Thursday, I attended a CLE for MNBA’s Health Law Section in which one of the deputy AG’s spoke about what the AG’s office had been doing in the area of health care for the last year. During her presentation, the deputy AG claimed that their office had been instrumental in getting the governor to address the issue of “dual elligibles” (people who eligible for both Medicare and other medical assistance programs) under the new Medicare Part D and that it had sent a letter to the governor’s office imploring him to act.

Unfortunately for the deputy AG, the governor’s general counsel was in attendance and confirmed that the only “action” by the AG was to send a letter at five o’clock on a Friday to the governor’s office which it learned about only because it was released to the media at the same time. The governor in fact had issued an executive order to deal with the situation but the AG was (surprise-surprise) attempting to take credit for getting them to act. The deputy AG then proceeded to back away from her statement with the “this is what I was told” maneuver.

I’ve attended CLE’s for the health law sectional for the last three years and each year we’ve had someone from the AG’s office attend. Two years ago a different deputy AG began his presentation by referring to pharmaceutical companies as the “axis of evil” (IIRC about a third of the audience that year worked for PharMa) and he was promptly pilloried for misstating the law on drug (re)importation.

Last year we had Mike Hatch speak just as he came back from Chicago when his daughters were acquitted. During his presentation, he trumpeted (and I remember he received some praise from the audience for this part) his office’s supposed role in trying to get the federal government to investigate the link between autism and the mercury content in certain vaccines given to children. It turned out when I got home to do my own research) that the federal government had already done some SIXTEEN different studies on the issue.

IMO this demonstrates that Hatch’s grandstanding goes beyond filing high profile lawsuits on dubious grounds to get himself in the public eye; it extends to trying to take credit for the hard work and initiative of others.
