Got an unrelated question with just a bit of a barb, but also some real curiousity as well: maybe you can ask aroud about it. I've been working through some audiobooks on the Constitution (up to the 1920's right now). It may be covered later in the series, but Justice Holmes (and later Chief Justice Hughs in 1937) stated: "The Constitution does not speak to the freedom of contract".
So ... how does this square away, with Constitutional Originalists? The "Liberty of Contract" doctrine is a pretty big item in conservative circles and is often used to bash labor regulation, but there is (according to two highly respected jurists) no constitutional basis for it.
