{"id":85572,"date":"2023-07-19T11:00:00","date_gmt":"2023-07-19T16:00:00","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=85572"},"modified":"2023-07-19T08:43:46","modified_gmt":"2023-07-19T13:43:46","slug":"a-matter-of-trust-2","status":"publish","type":"post","link":"https:\/\/www.shotinthedark.info\/wp\/?p=85572","title":{"rendered":"A Matter Of Trust"},"content":{"rendered":"\n<p>Self-governing society depends on people trusting each other, and the institutions we create.  <\/p>\n\n\n\n<p>Put a pin in that thought. <\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>A lot of people on social media, not to mention the victim&#8217;s family as quoted in this Fox9 tweet, were a little horrified by the <em>denouement <\/em>to this horrible case, which <a href=\"http:\/\/www.shotinthedark.info\/wp\/?p=79106\">we covered here almost two years ago:<\/a> <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">\u201cI just don&#39;t know what world or society we are living in anymore&quot;: Family members of the woman decapitated in Shakopee are dismayed after a judge deemed the man who committed the gruesome crime not guilty due to mental illness.  <a href=\"https:\/\/t.co\/1B14CAXpT6\">https:\/\/t.co\/1B14CAXpT6<\/a><\/p>&mdash; FOX 9 (@FOX9) <a href=\"https:\/\/twitter.com\/FOX9\/status\/1681548246265544704?ref_src=twsrc%5Etfw\">July 19, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>It never went to trial:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Alexis Saborit, 42,\u00a0was convicted of first-degree premeditated murder in court on May 11 in the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.fox9.com\/news\/homicide-investigation-underway-in-shakopee\" target=\"_blank\">death of 55-year-old America Thayer<\/a>. However, Judge Caroline Lennon ruled on Saborit&#8217;s mental competency on Monday, citing in part psychologists determined &#8220;[Sarboit&#8217;s] mental illness prevented him from understanding his actions were morally wrong,&#8221; the order reads&#8230;.<\/p>\n\n\n\n<p>The order discusses Saborti&#8217;s history of mental illness, including his hospitalizations for &#8220;bizarre delusions&#8221; early as March 2013. He suffered a traumatic brain injury after being in a coma from a car crash in 2017 and began experiencing auditory hallucinations and paranoid delusions.&nbsp;<\/p>\n\n\n\n<p>After the crash, he was hospitalized in May 2020 for believing there was a camera in his head after the crash and everyone could hear what he was thinking, according to court records. He was also diagnosed with various mental health disorders, including manic psychosis and delusional disorder, among others.\u00a0<\/p>\n\n\n\n<p>The defense argues since no expert testimony or evidence challenged the psychologist\u2019s opinions he was mentally ill at the time of the crime, he should not be held criminally liable.\u00a0<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.wayfair.com\/Three-Posts%E2%84%A2--Cynthiana-Microfiber-Sheet-Set-X112242097-L1224-K~W001131986.html\" target=\"_blank\"><\/a><\/p>\n\n\n\n<p>Now, on one level I get the horror and revulsion.  It&#8217;s a grisly, horrific crime. <\/p>\n<\/blockquote>\n\n\n\n<p>But determining whether someone is incompetent to stand trial &#8211; &#8220;insanity&#8221; &#8211; is, like self-defense, an &#8220;affirmative defense&#8221;; the defense affirms &#8220;Yes, my client did what he&#8217;s accused of, but he was so out of his mind that trying him for it would be pointless; he can&#8217;t participate in his own defense&#8221;.     As steep a hill as getting &#8220;self-defense&#8221; is to climb, insanity may be even harder to get past a judge. <\/p>\n\n\n\n<p>Or so one hopes.  <\/p>\n\n\n\n<p>So let&#8217;s un-pin that first bit from way above. <\/p>\n\n\n\n<p>Whatever the merits of the case (I don&#8217;t know), or Judge Lennon&#8217;s reasoningi &#8211; after this last five years in the Twin Cities, how many of you looked at this decision and thought &#8220;I just don&#8217;t trust that our legal system got this right&#8221;?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Self-governing society depends on people trusting each other, and the institutions we create.
