{"id":62953,"date":"2017-05-05T05:55:32","date_gmt":"2017-05-05T10:55:32","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=62953"},"modified":"2017-04-30T11:25:21","modified_gmt":"2017-04-30T16:25:21","slug":"judges-gone-wild","status":"publish","type":"post","link":"https:\/\/www.shotinthedark.info\/wp\/?p=62953","title":{"rendered":"Judges Gone Wild"},"content":{"rendered":"<p>Joe Doakes from Como Park emails:<\/p>\n<blockquote><p>This case turns on an idiotic interpretation of the statute which these three judges made, I suspect, because the judges don\u2019t agree with the notion of individual citizens having a right of self-defense and therefore choosing to sabotage that right by intentionally being obtuse.<\/p>\n<p>The case hinges on the definition of \u201ccarry\u201d as in \u201ccarry a pistol in a public place.\u201d\u00a0 What does that phrase mean? \u00a0The court decided \u201ccarry\u201d was not defined the same as the section of the statute right before this one, but instead was intended to have an entirely different definition in the broadest general sense to mean \u201cconvey or transport,\u201d the same as you\u2019d \u201ccarry\u201d a bag of groceries from the car to the house. \u00a0Can anyone imagine them being as cautious, as restrained, as obsequious to Webster\u2019s Dictionary, when deciding a gay rights or abortion case?<\/p>\n<p>Everybody knows the way you carry a gun in the car when driving from your house to the shooting range is to unload the gun, put the gun in a case, put the case in the trunk, and drive to the range.\u00a0 When you get there, you park, take the gun case out of the trunk and carry the gun case into the range.\u00a0 That is the ordinary, normal, and perfectly acceptable way to transport a firearm.\u00a0 It doesn\u2019t matter whether you\u2019re stone-cold sober or not: the procedure is the same.<\/p>\n<p>Yes, technically, you have \u201cconveyed or transported\u201d a gun in a public place, and yes, technically, you did it with your hands so the gun is \u201con or about your person,\u201d but until this case was decided, nobody would have believed you were \u201ccarrying a gun\u201d within the meaning of the Permit to Carry statute. And it\u2019s even dumber to believe there\u2019s a distinction between carrying a pistol in this manner versus carrying a rifle or shotgun in this manner.<\/p>\n<p>This ruling is idiotic.\u00a0 The Permit to Carry statute was intended to make it easier for honest citizens to carry a loaded gun in public, typically in a holster. \u00a0Everybody knows that \u2013 it was endlessly debated; enacted and struck down and enacted again; and it\u2019s been working just fine since it was adopted.\u00a0 I suspect these judges simply don\u2019t like the law.<\/p>\n<p>Note well: this is a City of St. Paul case meaning the liberal Democrats running this city are ones pushing the judges to tighten and narrow and undermine the law statewide, using a pathetic excuse for legal reasoning.\u00a0 Now imagine what they\u2019ll do to you if you are forced to shoot somebody.<\/p>\n<p>Joe Doakes<\/p><\/blockquote>\n<p>If the City of Saint Paul (and Minneapolis) can&#8217;t repeal the Pre-Emption Statute, they&#8217;ll undermine it in court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Joe Doakes from Como Park emails: This case turns on an idiotic interpretation of the statute which these three judges made, I suspect, because the judges don\u2019t agree with the notion of individual citizens having a right of self-defense and therefore choosing to sabotage that right by intentionally being obtuse.
