Let’s Try To Focus Here

I’ll give Obama this much; his administrtion is playing the “Is Kagan or is Kagan not gay?” card at just the right time; it’s occupying our peabrain media so much so that none of them, even were they so inclined, will ever even ask about her record on human and civil rights:

Elena Kagan said as a U.S. Supreme Court law clerk in 1987 that she was “not sympathetic” toward a man who contended that his constitutional rights were violated when he was convicted for carrying an unlicensed pistol.Kagan, whom President Barack Obama nominated to the high court this week, made the comment to Justice Thurgood Marshall, urging him in a one-paragraph memo to vote against hearing the District of Columbia man’s appeal.

Apologists say that she was reflecting the view of the “elite” bar in the years before Heller.

Rubbish.  Adolf Eichmann reflected the “legal” view of Germany’s elite for 12 years; he was still wrong.

We – the good guys – don’t have the votes to scupper Kagan.  I’m afraid it’s a done deal.

WELCOME MAHABLOG READERS!:  I responded to Barbara “Maha” O’Brian’s misleading, context-challenged little swipe at me in this post here, which is a vastly better-thought-out response than her original grab-bag of ofay stereotypes and lack of legal understanding, deserved.

You should ask Barbara a question, though; why does she delete comments that challenge her?  Does she have that big a need for control?  That’s kinda strange.

  1. Pundits say that all of Obama’s Supreme Court picks have to be a twofer (a member of two protected classes). With the first, we got a female and a wise Latina/o. With Kagen, we get a female and ?

  4. Kagan will be on the court this fall. All the GOP can do is ask questions of her to show the public what kind of nominee the President picks.

  5. I smell a female Bork here. She might be labeled as too liberal for conservatives and not progressive enough for the leftist crazies. If DK is a weathervane she might have to withdraw her nomination a la Miers(sp?). Don’t consider this a done deal people.

  7. I always wonder why liberals never get screwed on their SC picks. I mean, why do Republicans end up with the Souters of the world? Stevens was a Ford pick, Kennedy was a Reagan pick, for instance. Aren’t we due for a makeup call?

    Like “Pass the bill and see what’s in it,” confirm Kagan, and hope she’s the liberals’ Souter pick!

  8. Ben, Obama isn’t going to leave this nomination to chance. He is going to get the leftist he wants on the court.

    Republicans make mistakes on the court picks but for some reason the leftists never do. I am sure she has passed the liberal litmus test (funny how we never hear that term in the MSM when a Dem nominates a Judge isn’t it?) with flying colors.

  9. Jeff, the answer to your question is Democrats see politics as a blood sport. When Bush said he wanted to be a “uniter, not a divider” he was being genuine. When Obama said it, he was lying.

  11. Agree….Republicans have picked compromise candidates for the big court…many of them turned out to be hard left. Democrats know that this is how they really get power, so never do the same (pick a moderate who may actually be conservative). And Kagen is what? 49? Most likely she will be there for 30-35 years. Like the famous “long slow march through the institutions”, this is a plan to gain control for decades. It’s not how to get though the November election. Obama is trying to reshape America for the long term.
