{"id":986,"date":"2007-06-27T03:45:57","date_gmt":"2007-06-27T09:45:57","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/index.php\/index.php\/2007\/06\/27\/shots-fired-2\/"},"modified":"2012-04-12T06:28:09","modified_gmt":"2012-04-12T11:28:09","slug":"shots-fired-2","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=986","title":{"rendered":"Shots Fired"},"content":{"rendered":"<p>i&#8217;ve been following <a href=\"http:\/\/www.shotinthedark.info\/wp\/index.php\/index.php\/2007\/06\/11\/self-defense\/\">the story of the Treptow case<\/a> &#8211; where a legal permit-holder shot an undercover cop who was allegedly behaving <em>very <\/em>aggressively, and finally allegedly pulled a gun on the man&#8217;s wife &#8211; since the beginning.<\/p>\n<p>Joel Rosenberg&#8217;s been following it even more closely. Unaccountably, I missed <a href=\"http:\/\/joelrosenberg.livejournal.com\/201179.html\">his analysis of the release &#8211; the <em>almost-complete <\/em>release &#8211; of the relevant 911 transcripts<\/a>, which he posted last Friday (<a href=\"http:\/\/ellegon.com\/pub\/treptow_911.pdf\">actual transcripts here<\/a>).\u00a0<\/p>\n<p>Joel&#8217;s analysis (with some emphases added by me):<\/p>\n<blockquote><p>Some other items of interest, and\/or comment:<\/p>\n<ul>\n<li>Officer Friendly &#8212; see p. 6 &#8212; either <strong>didn&#8217;t notice or didn&#8217;t think to mention that there were two kids in the car<\/strong>.\u00a0<\/li>\n<li><strong>He identifies a &#8220;white male&#8221; and a &#8220;white female.&#8221;<\/strong>\u00a0\u00a0[Remember this: the office notes no children.\u00a0 It&#8217;ll be important later.] That&#8217;s not redacted.<\/li>\n<li>Any identification of Officer Friendly&#8217;s race, age, size and <span style=\"font-style: italic\">demeanor <\/span>is redacted.\u00a0<\/li>\n<li><strong>One caller<\/strong>&#8212; see p. 4 &#8212; <strong>says he saw Officer Friendly pull a gun<\/strong>.\u00a0 What&#8217;s not clear from the transcript is how long between that and when the officer got shot.\u00a0<\/li>\n<li>That&#8217;s kind of important.\u00a0 <strong>If you believe Officer Friendly&#8217;s story, he drew in response to Treptow pulling a gun on him<\/strong> &#8212; I guess he&#8217;d claim that retreat was neither practical nor safe.\u00a0 <strong>Surely, if that was the case, he would likely immediately have shot the fellow who he thought was trying to kill him &#8212; after all, if you believe him, he didn&#8217;t draw the gun to further intimidate a guy&#8230;.\u00a0 A second or so gap in that narrative, and Officer Friendly&#8217;s story becomes less plausible, even without the other witnesses<\/strong>. His explanation &#8212; given that &#8212; then becomes that he didn&#8217;t shoot because he was afraid of hitting the kids that he didn&#8217;t see, the wife that he did, or that he froze under stress, and that he just left that out while he was talking on tape on 911.\u00a0 Not impossible, but likely a hard sell.\u00a0<\/li>\n<li>Occam&#8217;s Razor is a guide, and just a guide, but you have to assume a lot less complexity to read it as Officer Friendly drew his gun to intimidate Treptow, and didn&#8217;t switch gears into a killing mode quickly enough when Treptow, thinking that he and his wife were about to be shot &#8212; not being able to read Officer Friendy&#8217;s mind, but just see his unambiguous actions &#8212; drew and fired in self-defense.)<\/li>\n<li>Same caller heard &#8220;arguing before.&#8221;<\/li>\n<li><strong>Officer Friendly, under stress, doesn&#8217;t have the plate number of Treptow&#8217;s Rendezvous SUV.\u00a0 <\/strong>That&#8217;s understandable; he&#8217;s just been shot.\u00a0 But, more significantly, <strong>he doesn&#8217;t refer to a previous 911 call in which he called in the plate number on this supposedly road-raging driver.\u00a0 Could it be because he never made that call<\/strong>?\u00a0<\/li>\n<\/ul>\n<\/blockquote>\n<p>Why was all mention of the officer&#8217;s demeanor redacted?\u00a0 I&#8217;m smelling a Police union lawyer involved.\u00a0 Understandable, of course, but curious.<\/p>\n<p>I&#8217;ll continue to follow this.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>i&#8217;ve been following the story of the Treptow case &#8211; where a legal permit-holder shot an undercover cop who was allegedly behaving very aggressively, and finally allegedly pulled a gun on the man&#8217;s wife &#8211; since the beginning.
