In one of the highlights of last week, all nine justices <\/em>of the SCOTUS united across ideological lines to beat Hennepin County like a pimp beating one of his girls. <\/p>\n\n\n\n Geraldine Tyler\u00a0owed<\/a>\u00a0a $15,000 tax debt on a one-bedroom Minneapolis condo; to pay the debt, Hennepin County sold her home for $40,000 \u2014 and kept the extra $25,000 beyond what was owed. Chief Justice Roberts wrote in the\u00a0opinion<\/a>\u00a0of the Court that the taxpayer must \u201crender unto Caesar what is Caesar\u2019s, but no more,\u201d effectively ending the practice of home equity theft.<\/p>\n<\/blockquote>\n\n\n\n How clear-cut was Henco’s abuse? This <\/em>clear-cut (emphasis added):<\/p>\n\n\n\n Justice Neil Gorsuch filed a concurring opinion, which Justice Ketanji Brown Jackson joined<\/strong>, adding that the county\u2019s action also violates the Eighth Amendment\u2019s Excessive Fines Clause.<\/p>\n\n\n\n \u201cEconomic penalties imposed to deter willful noncompliance with the law are fines by any other name,\u201d he wrote. \u201cAnd the Constitution has something to say about them: They cannot be excessive.\u201d<\/p>\n<\/blockquote>\n\n\n\n Any day that Henco gets clobbered is a wonderful one. <\/p>\n","protected":false},"excerpt":{"rendered":" Never thought I”d see the day.
