You figure that if you are forced to shoot somebody and you\u2019re up-front with the cops, the prosecutor will see that you\u2019re a Good Guy and will drop the charges, right? \u00a0\u00a0You can\u2019t imagine the prosecutor will twist your words and play dirty tricks to cheat you out of your rights, all in a blind effort to appease a mob.\u00a0 That wouldn\u2019t happen in Minnesota, right?<\/p>\n
\u201cIn the hour-long interview with Minnesota Bureau of Criminal Apprehension (BCA) investigators, Yanez repeatedly used the pronoun \u201cit\u201d instead of \u201cgun\u201d or \u201cfirearm.\u201d Prosecutors told jurors that the language proves Yanez never saw a gun. However, prosecutors never played the video during its case, thinking it more strategic to introduce the footage last Friday during the defense\u2019s case. It is common practice to play a defendant\u2019s interview with investigators during the state\u2019s case.<\/p>\n
\u201cThe rules of evidence clearly allow for the statement\u2019s admission into evidence during cross examination,\u201d said a written statement issued … by the Ramsey County attorney\u2019s office. \u201cStrategically, we felt the statement would be best used for impeachment purposes on cross examination when the defendant took the stand in his own defense.\u201d<\/p>\n
But the move backfired [at trial] when Ramsey County District Judge William H. Leary III criticized the prosecution\u2019s timing and refused to allow the video. Defense attorney Thomas Kelly objected to the prosecution\u2019s effort, calling it an \u201cimproper impeachment\u201d of Yanez and asserting that the state allegedly withheld the video in order to compel Yanez\u2019s testimony.\u201d<\/p>\n
Twisting words.\u00a0 Dirty tricks.\u00a0 Mob waiting outside.<\/p>\n
Here\u2019s the really fascinating question: is this merely local politicians and bureacrats doing their best to achieve justice, but their best isn\u2019t very good?\u00a0\u00a0 Or is this part of a concerted effort at all levels to make gun ownership not only onerous, but even dangerous, for law-abiding citizens?\u00a0 Defend yourself and we\u2019ll bury you, to make sure nobody else defends themselves.<\/p>\n
