{"id":54907,"date":"2015-08-26T05:00:10","date_gmt":"2015-08-26T10:00:10","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=54907"},"modified":"2015-08-22T20:49:43","modified_gmt":"2015-08-23T01:49:43","slug":"punt","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=54907","title":{"rendered":"Punt"},"content":{"rendered":"<p>Joe Doakes from Como Park writes in re the Minnesota police union&#8217;s lawsuit against the NFL for barring off-duty officers from carrying their firearms at games:<\/p>\n<blockquote><p>The NFL says only on-duty peace officers can carry during football games.\u00a0 An off-duty officer was relieved of his weapon at TCF Stadium.<\/p>\n<p>The trial court held the NFL cannot exclude him from carrying his weapon because the Minnesota permit-to-carry law doesn\u2019t give property owners that right.<\/p>\n<p>The Court of Appeals punted.\u00a0 It says the permit-to-carry law doesn\u2019t apply to cops, on duty or off, so that particular law doesn\u2019t determine whether the property owner must admit them, or can refuse to admit them.<\/p>\n<p>Other laws may apply so the case was sent back for a do-over.<\/p>\n<p>Personally, it seems to me that an off-duty cop should be in the same category as a permitted carrier &#8211;\u00a0 trusted to carry a weapon by society, but maybe not trusted by the property owner, so if it wants to turn us both away, that\u2019s its right. \u00a0\u00a0It\u2019s also possible the legislature could have intended off-duty cops to be treated differently from permitted carriers, so I think the appeals court decided correctly when it sent the case back.<\/p>\n<p>Joe Doakes<\/p><\/blockquote>\n<p>It&#8217;s a dilemma for a judge; how to serve both political correctness\u00a0<em>and\u00a0<\/em>the state&#8217;s monopoly on force.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Joe Doakes from Como Park writes in re the Minnesota police union&#8217;s lawsuit against the NFL for barring off-duty officers from carrying their firearms at games: The NFL says only on-duty peace officers can carry during football games.\u00a0 An off-duty officer was relieved of his weapon at TCF Stadium.
