{"id":32966,"date":"2012-12-27T05:00:55","date_gmt":"2012-12-27T11:00:55","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=32966"},"modified":"2012-12-27T07:57:43","modified_gmt":"2012-12-27T13:57:43","slug":"patrician-law-plebeian-law","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=32966","title":{"rendered":"Patrician Law, Plebeian Law"},"content":{"rendered":"<p>Most &#8220;gun control&#8221; laws have nothing to do with controlling crime; they are about making gun ownership not merely onerous, but legally perilous.<\/p>\n<p>And they work &#8211; where &#8220;work&#8221; means &#8220;<a href=\"http:\/\/legalinsurrection.com\/2012\/12\/the-importance-of-prosecuting-david-gregory-if-he-violated-d-c-s-gun-law\/\">scare law-abiding people out of their sacred duty and privilege to defend themselves, their families and their society from the scum around us<\/a>&#8220;:<\/p>\n<blockquote><p>Prior to yesterday, I never would have thought that possession of an empty magazine, kept separate from ammunition or a weapon, would violate the law, so I sympathize with Gregory on that point.<\/p>\n<p>But I\u2019m less sympathetic than you might expect because fear of unintentionally violating gun laws is one of the things that has kept me from purchasing a handgun. As you know, I took the NRA safety course over a year ago. But I\u2019m a legal resident of Rhode Island who lives much of the year in New York, so there\u2019s an issue of whether I could obtain a NY permit, which is needed even to keep a gun in the home. And then there\u2019s the issue of transportation back and forth, and complying with the requirements to avoid prosecution as I pass through Massachusetts.<\/p>\n<p>It all became such a bureaucratic jungle that I just deferred for the time being.<\/p><\/blockquote>\n<p>That&#8217;s attorney William Jacobson at\u00a0<em>Legal Insurrection<\/em> in a piece on the importance of prosecuting NBC News&#8217; David Gregory &#8211; who is a rabid anti-gunner and makes no &#8220;journalistic&#8221; bones about it, and whose kids attend a school protected by the same armed guards that he and his industry decry for the proles &#8211; produced a 30-round NATO STANAG magazine (which fits the AR15 and most other NATO rifles of the same caliber) during a segment\u00a0haranguing\u00a0for gun control on one of the Sunday Morning shows last week.<\/p>\n<p>Jacobson, by the way, cuts Gregory some slack in assuming the &#8220;infraction&#8221; was inadvertent. \u00a0<a href=\"http:\/\/legalinsurrection.com\/2012\/12\/d-c-police-nbc-requested-and-was-denied-permission-to-use-high-capacity-magazine-in-news-segment\/\">NBC apparently asked DC police for permission to\u00a0possess\u00a0the magazine for use in the &#8220;story&#8221;<\/a> (heh), and were denied. \u00a0 Gregory &#8211; or at least several people in his editorial chain of command &#8211; <em>knew that they were breaking a law<\/em>&#8230;<\/p>\n<p>&#8230;that was designed, like all of DC&#8217;s gun laws, to ensnare and make criminals out of as many law-abiding gun owners as possible.<\/p>\n<p>Against that? \u00a0Howard Kurtz &#8211; a center-left journalist &#8211; <a href=\"http:\/\/daily-download.com\/david-gregory-piers-morgan-assault-guns\/\">responds<\/a> (with emphasis added by me):<\/p>\n<blockquote><p>Was it a stunt? Yep, and an eye-catching one. Was Gregory being aggressive with the NRA chief, or seeming to push gun control in a confrontational interview? All that is up for debate.<\/p>\n<p><strong>But a police probe over what I assume was an empty ammo clip is a total waste of time<\/strong>. What it demonstrates above all is that journalists are getting ensnared in the political war over gun control.<\/p><\/blockquote>\n<p>No, Howard. \u00a0&#8220;Journalists&#8221; who are actively working to destroy a constitutional liberty they don&#8217;t believe to be in fashion\u00a0<em>broke a law<\/em>. \u00a0If it had been any other citizen &#8211; Wayne LaPierre, or (occasional NRA spokesbabe) Sarah Michelle Gellar, or you or I &#8211; the DC police would be going over them\u00a0<em>right now\u00a0<\/em>with all the grace the NYPD used in going over Abner Louima. \u00a0Rhetorically speaking. \u00a0Probably.<\/p>\n<p>If it&#8217;s a &#8220;waste of time&#8221; for Gregory, then what is it for\u00a0<em>every other otherwise honest citizen in DC\u00a0<\/em>and the area that&#8217;s gotten snagged up in DC gun laws&#8217; byzantine picayunities over the past 40 years?<\/p>\n<p>Like these guys,\u00a0Mickey Kaus: \u00a0the DC Police\u00a0<a href=\"http:\/\/monachuslex.com\/?p=2315\">didn&#8217;t consider it a &#8220;waste of time&#8221; with two of the people who were wounded<\/a>\u00a0defending our worthless federal government overseas:<\/p>\n<blockquote><p>After being injured on foreign soil while defending his nation\u2019s freedom, Lt. Kim returned home to find that, in DC at least, there is very little of it left to defend. Lt. Kim was transporting his legally owned firearms from his parent\u2019s home in New Jersey to South Carolina when he stopped at Walter Reed Army Hospital in DC for an appointment. Bad move!<\/p>\n<p>After getting lost and pulled over by police, he was arrested, thrown in jail, and had over $10,000 in guns seized by the District. Despite the fact that he had no evil intent, Lt. Kim didn\u2019t get a pass \u2026 but I bet Gregory will.<\/p>\n<p>Or how about the case of Army Specialist Adam Meckler? Meckler, who had recently ended his active duty tour, was dropping off records at the VFW in DC when they discovered a few rounds of ammunition in his bag left over from recreational shooting. Let me repeat that \u2026 a few rounds of ammo \u2026 not a gun \u2026 not a knife \u2026 not an RPG \u2026 a few rounds of 9mm ammo.<\/p>\n<p>For that \u2018crime\u2019 Specialist Meckler was handcuffed, treated like a terrorist, arrested, and forced to accept a plea deal that will mark the honored veteran for the rest of his life. But will the same happen to Gregory? I don\u2019t think so.<\/p>\n<p>So let\u2019s recap. Two soldiers, absent any evil intent, violate the strict letter of DC\u2019s draconian gun control laws and end up getting no leniency from a justice system that serves anything but true justice.<\/p><\/blockquote>\n<p>Apparently, to regular plebeians,\u00a0<em>the letter of DC&#8217;s stupid law<\/em> isn&#8217;t a &#8220;waste of time&#8221;.<\/p>\n<div>\u00a0And if the media\u00a0<em>is\u00a0<\/em>in fact above the law, perhaps they should just say so, and make sure it&#8217;s clearly understood.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Most &#8220;gun control&#8221; laws have nothing to do with controlling crime; they are about making gun ownership not merely onerous, but legally perilous.
