{"id":31096,"date":"2012-10-16T05:55:39","date_gmt":"2012-10-16T10:55:39","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=31096"},"modified":"2012-10-16T07:13:17","modified_gmt":"2012-10-16T12:13:17","slug":"our-moron-judiciary","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=31096","title":{"rendered":"Our Moron Judiciary"},"content":{"rendered":"<p>Retired SCOTUS Justice Stevens is many things.<\/p>\n<ul>\n<li>He&#8217;s a liberal dinosaur.<\/li>\n<li>If you are either a pro-Second-Amendment Democrat or a Gary Johnson voter, he is a big reason to suck it up and vote for Mitt; the thought that another Obama term means three more &#8220;justices&#8221; like him should keep you up at night.<\/li>\n<li>He&#8217;d seem to be one of those lawyers that you just want to punch when they&#8217;re in their twenties and thirties and strutting around showing everyone how much smarter than everyone else they like to think they are.<\/li>\n<li>He&#8217;s either hopelessly ignorant, or he&#8217;s senile<\/li>\n<\/ul>\n<p>This piece in the WashEx is <a href=\"http:\/\/washingtonexaminer.com\/justice-stevens-second-amendment-is-no-obstacle-to-banning-automatic-weapons\/article\/2510773#.UHzJdZG9KSO\">evidence for all of the above<\/a>:<\/p>\n<blockquote><p>Retired Supreme Court Justice John Paul Stevens called for Congress to tighten gun laws in the wake of shootings such as the one that took place in Aurora, Colorado.<\/p><\/blockquote>\n<p>So Aurora can be as safe as Chicago!<\/p>\n<blockquote><p>Stevens noted that the legal precedent for restricting gun rights \u2014 United States vs. Miller \u2014 still stands, despite the ruling in the 2005 Heller case that overturned the Washington, D.C., ban on owning handguns, even in one\u2019s own home.<\/p><\/blockquote>\n<p>Which proves the &#8220;dinosaur&#8221; case.<\/p>\n<p>The &#8220;senile&#8221; case? \u00a0That comes next (with emphasis added by me):<\/p>\n<blockquote><p>\u201c[Miller] was generally understood to limiting the scope of the Second Amendment to the uses of <strong>arms that were related to military activities<\/strong>,\u201d Stevens said today during a question-and-answer session after a speech today with the Brady Center to Prevent Gun Violence\u2019s Legal Action Project. \u201cThe Court did not overrule Miller [in Heller].<\/p><\/blockquote>\n<p>That&#8217;s technically true. \u00a0<em>Heller<\/em> overruled a specious, logically-vacuous train of opinion in lower courts that\u00a0<em>Miller\u00a0<\/em>meant that the Second Amendment was not a right &#8220;Of the People&#8221;, but that it might refer to assemblies of people like the National Guard.<\/p>\n<p>Remember the bolded bit. \u00a0We&#8217;ll be coming back to it very shortly.<\/p>\n<p>Back to Justice and Dolt Stevens:<\/p>\n<blockquote><p>Instead it \u2018read Miller to say only that the Second Amendment does not protect those weapons not typically possessed by law-abiding citizens for lawful purposes, such as short-barreled shotguns . . . Thus, the Second Amendment provides no<strong> obstacle to regulations permitting the ownership or the use of the sorts of the automatic weapons<\/strong> used in the tragic multiple killings in Virginia, Colorado, or Arizona in recent years.\u201d<\/p><\/blockquote>\n<p>For starters, Stevens &#8211; like the entire generation of bobbleheaded activists that spawned him &#8211; contradicts himself; he said\u00a0<em>Miller\u00a0<\/em>was limited in scope to the use of military weapons &#8211; which\u00a0<em>are<\/em>, largely, &#8220;automatic&#8221;. \u00a0Meaning&#8230;<\/p>\n<p>&#8230;well, not what &#8220;Justice&#8221; and senile fool Stevens thinks. \u00a0Here&#8217;s some remedial firearms education: \u00a0this is &#8220;automatic&#8221;:<\/p>\n<p><iframe loading=\"lazy\" src=\"http:\/\/www.youtube.com\/embed\/5GOwLGeWlrY\" frameborder=\"0\" width=\"400\" height=\"225\"><\/iframe><\/p>\n<p>This is &#8220;Semi-Automatic&#8221; &#8211; a mode found on many hunting firearms and possibly the majority of personal defensive handguns:<\/p>\n<p><object width=\"425\" height=\"344\" classid=\"clsid:d27cdb6e-ae6d-11cf-96b8-444553540000\" codebase=\"http:\/\/download.macromedia.com\/pub\/shockwave\/cabs\/flash\/swflash.cab#version=6,0,40,0\"><param name=\"src\" value=\"http:\/\/swf.tubechop.com\/tubechop.swf?vurl=l9RXQ2g0qbU&amp;start=25.54&amp;end=40.72&amp;cid=600124\" \/><param name=\"allowfullscreen\" value=\"true\" \/><embed width=\"425\" height=\"344\" type=\"application\/x-shockwave-flash\" src=\"http:\/\/swf.tubechop.com\/tubechop.swf?vurl=l9RXQ2g0qbU&amp;start=25.54&amp;end=40.72&amp;cid=600124\" allowfullscreen=\"true\" \/><\/object><\/p>\n<p>It was\u00a0<em>semi-<\/em>automatic weapons that were used in virtually every major shooting &#8211;\u00a0<em>not full\u00a0<\/em><em>automatic<\/em>. \u00a0The death tolls were not a function of gun&#8217;s firing mechanism, but of the fact that the victims were packed into small spaces and rendered defenseless&#8230;<\/p>\n<p>&#8230;by the laws the likes of Justice Stevens foisted on us.<\/p>\n<blockquote><p>Stevens also had a recommendation for people who keep a weapon in their homes for self-defense purposes. \u201cMaybe you have some kind of constitutional right to have a cell phone with a pre-dialed 911 in the number at your bedside and that might provide you with a little better protection than a gun which you\u2019re not used to using,\u201d he said to laughter.<\/p><\/blockquote>\n<p>My next 200 rounds at the range is dedicated to you, &#8220;Justice&#8221; Idiot Stevens.<\/p>\n<p>As will be my next semi-automatic rifle purchase.<\/p>\n<p>You&#8217;re welcome.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Retired SCOTUS Justice Stevens is many things.
