{"id":23193,"date":"2011-09-29T12:00:42","date_gmt":"2011-09-29T17:00:42","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=23193"},"modified":"2011-12-07T08:26:09","modified_gmt":"2011-12-07T14:26:09","slug":"apropos-not-much-part-vi-2","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=23193","title":{"rendered":"Apropos Not Much, Part VI"},"content":{"rendered":"<p>For the past week that I&#8217;ve been writing this series on defamation law in Minnesota, I&#8217;ve been focusing on the letter and spirit (as captured in case law) of the law.<\/p>\n<p>Today, I&#8217;m going to go down a tangent, and talk about the mechanics of the law &#8211; specifically, how legal records work.<\/p>\n<p>Or, rather, how they don&#8217;t work.<\/p>\n<p>When you to google and search, for example, for &#8220;<a href=\"http:\/\/www.google.com\/search?rlz=1C1CHKZ_enUS440US440&amp;gcx=w&amp;sourceid=chrome&amp;ie=UTF-8&amp;q=dui+records+Minnesota\">DUI Records Minnesota<\/a>&#8220;, you get quite a few sites; once you get out of the ad hits with the pink backgrounds, you are helpfullly presented with \u00a0quite a few options purporting to allow you to &#8220;search Minnesota DUI records online!&#8221;.<\/p>\n<p>Sounds promising! \u00a0And after all, isn&#8217;t that the wonder of the Internet? That all information is instantly available online?<\/p>\n<p>I tried the first one after the ad links; &#8220;<a href=\"http:\/\/www.duirecords.org\/minnesota\/\">duirecords.org<\/a>&#8220;, which promises that you can &#8220;Search MN DUI Public Arrest Records Online&#8221;. \u00a0And just to be curious, I typed in my own name.<\/p>\n<p>And I got back something that made my heart sink into my stomach:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23195\" rel=\"attachment wp-att-23195\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23195\" title=\"It's Me!\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Its-Me1.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Its-Me1.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Its-Me1-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Its-Me1-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>&#8230;that&#8217;s me!<\/p>\n<p>But then I thought about it for a moment. \u00a0<em>I&#8217;ve never had a DUI. \u00a0<\/em>I&#8217;ve never had any form of impaired driving contact with the police &#8211; I&#8217;ve never been pulled over on suspicion of any sort of drunk driving. \u00a0Nothing, \u00a0Zero. \u00a0Zip. \u00a0Never.<\/p>\n<p>There&#8217;s a reason for that. \u00a0<em>I don&#8217;t drive drunk<\/em>. \u00a0Indeed, <em>I rarely have more than two drinks at a sitting<\/em>.<\/p>\n<p>And yet this site &#8211; this site that purports to &#8220;Search Public Records&#8221; to return DUI convictions &#8211; was saying that I&#8217;d had a DUI!<\/p>\n<p>So I wondered &#8211; given that nearly 10% of Minnesotans <em>do <\/em>have a drunk driving record,\u00a0what other Minnesotans have been convicted of driving under the influence?<\/p>\n<p>I picked a few names, completely at random: \u00a0I started with Brian &#8220;Saint Paul&#8221; Ward, of <em>Fraters Libertas<\/em>, a bunch of known drinkers:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23196\" rel=\"attachment wp-att-23196\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23196\" title=\"saint\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/saint.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/saint.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/saint-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/saint-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>Wow.<\/p>\n<p>Next, \u00a0I tried my friend and radio cohort, Ed Morrissey, who has publicly disclosed he lives in Eagan.<\/p>\n<p>And I was shocked:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23197\" rel=\"attachment wp-att-23197\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23197\" title=\"ed\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/ed.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/ed.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/ed-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/ed-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>Holy crap. \u00a0You think you know a guy!<\/p>\n<p>Next &#8211; since our last gubernatorial race was settled by a bogus &#8220;DUI&#8221; charge against Tom Emmer, I thought I&#8217;d see if what was fair for the goose were fair for the gander. \u00a0Does Mark Dayton have a &#8220;drunk driving record?&#8221;<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23235\" rel=\"attachment wp-att-23235\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23235\" title=\"Dayton\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Dayton1.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Dayton1.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Dayton1-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/Dayton1-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>Wow! \u00a0Someone tell the media!<\/p>\n<p>But I&#8217;m starting to smell a rat. \u00a0It almost looks as if this site will <em>turn up a record on almost anyone<\/em>.<\/p>\n<p>I tried Archbishop John C. Nienstedt, the supreme poobah (I&#8217;m a little fuzzy on the terms of the Catholic hierarchy) of the Archdiocese of Minneapolis and Saint Paul:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23199\" rel=\"attachment wp-att-23199\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23199\" title=\"nienstedt\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/nienstedt.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/nienstedt.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/nienstedt-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/nienstedt-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>And, finally, just out of a fit of untrammelled serendipity, I entered the name of my favorite Twin Cities&#8217; blogger, a person whose keen insights, nimble wit and sparkling writing have enlivened many an idle morning, <a href=\"http:\/\/ptable.blogspot.com\/\">Professor William Gleason<\/a>, a chemistry professor at the U of M:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23200\" rel=\"attachment wp-att-23200\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23200\" title=\"gleason\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/gleason.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/gleason.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/gleason-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/gleason-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>Note: \u00a0Someone pointed out that I got Gleason&#8217;s middle initial wrong. \u00a0No, I did not! \u00a0Go search the &#8220;database&#8221;; there are a plethora of William Gleasons out there! \u00a0Dozens! \u00a0Including the one with Professor and Blogger Gleason&#8217;s middle initial!<\/p>\n<p>It \u00a0seems <em>everyone <\/em>has a DUI!<\/p>\n<p>So I clicked on the &#8220;results&#8221; link:<\/p>\n<p><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23201\" rel=\"attachment wp-att-23201\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23201\" title=\"The Whammy\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/The-Whammy.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/The-Whammy.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/The-Whammy-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/The-Whammy-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>What? I&#8217;ve gotta <em>pay <\/em>for public records?<\/p>\n<p>Well,no. \u00a0The site above is an <em>advertising <\/em>site. \u00a0Indeed, it&#8217;s a form of <em>spam<\/em>.<\/p>\n<p>Indeed, if you google virtually any form of legal activity &#8211; <a href=\"http:\/\/www.google.com\/search?rlz=1C1CHKZ_enUS440US440&amp;gcx=w&amp;sourceid=chrome&amp;ie=UTF-8&amp;q=divorce+records+mn\">divorce<\/a>, <a href=\"http:\/\/www.google.com\/search?rlz=1C1CHKZ_enUS440US440&amp;gcx=w&amp;sourceid=chrome&amp;ie=UTF-8&amp;q=dui+records+Minnesota#pq=divorce+records+minnesota&amp;hl=en&amp;cp=2&amp;gs_id=a&amp;xhr=t&amp;q=criminal+records+minnesota&amp;pf=p&amp;sclient=psy-ab&amp;rlz=1C1CHKZ_enUS440US440&amp;source=hp&amp;pbx=1&amp;oq=crrecords+Minnesota&amp;aq=0c&amp;aqi=g-c3g-b1&amp;aql=&amp;gs_sm=&amp;gs_upl=&amp;bav=on.2,or.r_gc.r_pw.&amp;fp=ea639d6bce5fe0b0&amp;biw=1024&amp;bih=653\">criminal records<\/a>, bankruptcy &#8211; you will find pages and pages of these spam and scam sites, all designed to get you to pay money for what are, at most, slightly repackaged Google searches.<\/p>\n<p>What &#8220;duirecords.org&#8221; does is take virtually any input you give it, run a search on, say, Google, spits back the results to make it look like it has something, sucks you in to a link to make you pay for&#8230;<\/p>\n<p>&#8230;well, that&#8217;s as far as I pushed it. \u00a0I&#8217;m not going to pay to find out.<\/p>\n<p>Now, you <em>can\u00a0<\/em>get public records &#8211; or at least, names and charges and dates &#8211; from the <a href=\"https:\/\/cch.state.mn.us\/\"><em>official <\/em>Minnesota court records<\/a>\u00a0(you have to click &#8220;Begin Search&#8221;, and accept the disclaimer). \u00a0Wherein you&#8217;ll find that in the past 15 years, there has been <em>no <\/em>&#8220;Mitchell P. Berg&#8221; convicted of DUI anywhere in Minnesota &#8211; and that I&#8217;ve been pulled over for expired tabs and forgetting my insurance card.<\/p>\n<p>Expensive? Dumb? \u00a0Sure &#8211; but not DUI.<\/p>\n<p>&#8212;&#8212;&#8212;-<\/p>\n<p>The takeaway is this: \u00a0Say I were to write &#8220;John Doe, Age 46, of Mazeppa, was convicted of DUI&#8221; based on the output of the &#8220;<a href=\"http:\/\/duirecords.org\">DuiRecords.org<\/a>&#8221; website&#8230;:<\/p>\n<div id=\"attachment_23202\" style=\"width: 1034px\" class=\"wp-caption alignleft\"><a href=\"http:\/\/www.shotinthedark.info\/wp\/?attachment_id=23202\" rel=\"attachment wp-att-23202\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-23202\" class=\"size-full wp-image-23202\" title=\"doe\" src=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/doe.gif\" alt=\"\" width=\"1024\" height=\"768\" srcset=\"http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/doe.gif 1024w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/doe-300x225.gif 300w, http:\/\/www.shotinthedark.info\/wp\/wp-content\/uploads\/2011\/09\/doe-400x300.gif 400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><p id=\"caption-attachment-23202\" class=\"wp-caption-text\">I specifically disclaim any insinuation that any Mr. Doe of Mazeppa has ever committed any crime, by the way. This is just an example.<\/p><\/div>\n<p>&#8230; believing it to be a genuine public records website, rather than, as we&#8217;ve shown, an <em>advertising <\/em>site that turns up &#8220;records&#8221; on <em>anyone. \u00a0<\/em><\/p>\n<p>And ten, say, someone wrote to tell me, specifically, that &#8220;your &#8220;source&#8221; on Mr. Doe is an ad site, not a source of actual public records?&#8221;<\/p>\n<p>And yet, I doubled down on my story &#8211; redoubling my assertion that Mr. Doe had been convicted of DUI? \u00a0Rather than retracting it and apologizing to Mr. Doe?<\/p>\n<p>Well, that could fairly be seen as &#8220;failing to take reasonable care&#8221; to ensure that a defamatory statement (remember, accusations of infamous crimes are defamation <em>per se <\/em>under Minnesota law)\u00a0is accurate&#8221;.<\/p>\n<p>OK. \u00a0There is no serendipity at all in this series. \u00a0There&#8217;s a point.<\/p>\n<p>We&#8217;re getting to it.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>For the past week that I&#8217;ve been writing this series on defamation law in Minnesota, I&#8217;ve been focusing on the letter and spirit (as captured in case law) of the law.
