{"id":23001,"date":"2011-09-19T07:00:10","date_gmt":"2011-09-19T12:00:10","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=23001"},"modified":"2011-09-19T07:13:06","modified_gmt":"2011-09-19T12:13:06","slug":"free-at-last","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=23001","title":{"rendered":"Free At Last"},"content":{"rendered":"<p>Michael Hansen was freed last month after six years in prison for a murder he didn&#8217;t commit.<\/p>\n<p>And now the county attorney has<a href=\"http:\/\/www.startribune.com\/local\/north\/130094243.html\">\u00a0finally dropped the charges<\/a>, aborting the new trial that was called for last summer:<\/p>\n<blockquote><p>&#8230;Douglas County Attorney&#8217;s Office dropped all charges against him and said it &#8220;no longer believes that it can prove the defendant&#8217;s guilt beyond a reasonable doubt.&#8221;<\/p>\n<p>The exoneration came after a judge in July had vacated Hansen&#8217;s conviction and ordered a new trial based on evidence presented by the Innocence Project of Minnesota, saying that there was evidence that the Ramsey County medical examiner might have given &#8220;false or incorrect&#8221; testimony at the first trial. He was released from prison in August.<\/p><\/blockquote>\n<p>The death of Hansen&#8217;s daughter was a tragedy. \u00a0 His conviction and imprisonment were partly the result of a bureaucrat&#8217;s botch&#8230;<\/p>\n<blockquote><p>In a review whose results were issued early this month, Ramsey County said [Ramco medical examiner Michael] McGee complied with all state laws and with his contract with the county.<\/p><\/blockquote>\n<p>&#8230;(in other words, &#8220;the dog ate his homework, but the rules say there&#8217;s nothing you can do about it), and the assumption that the father <em>had <\/em>to be guilty.<\/p>\n<blockquote><p>McGee couldn&#8217;t be reached for comment Sunday.<\/p>\n<p>Erika Applebaum, executive director of the Innocence Project of Minnesota, said that if anything can be learned from Hansen&#8217;s experience, it&#8217;s that juries should not blindly accept all expert testimony.<\/p><\/blockquote>\n<p>Naturally, The System doesn&#8217;t like mere peasants getting uppity and questioning their &#8220;experts&#8221;; they&#8217;ve been bellyaching about juries asking too many questions &#8211; the &#8220;<a href=\"http:\/\/www.google.com\/url?sa=t&amp;source=web&amp;cd=3&amp;ved=0CEkQFjAC&amp;url=http%3A%2F%2Fwww.npr.org%2F2011%2F02%2F06%2F133497696%2Fis-the-csi-effect-influencing-courtrooms&amp;ei=eS53TruJD8yHsALx5-WLBQ&amp;usg=AFQjCNFud6n9sOHjDngVALre3xJy6sELAw&amp;sig2=ZaTHQVF8s0jJPDTRW0PeoQ\">CSI Effect<\/a>&#8221; &#8211; and in some places is <a href=\"http:\/\/blogs.wsj.com\/law\/2010\/05\/28\/ohio-takes-action-against-the-csi-effect-on-juries\/\">taking action<\/a> to stymie those exact questions.<\/p>\n<p>It&#8217;s <a href=\"http:\/\/minnesota.publicradio.org\/display\/web\/2011\/09\/05\/ramsey-county-medical-examiner-faces-investigation\/\">not the only question<\/a> being raised about the work of McGee, the Ramco medical examiner whose testimony put Hansen away \u00a0Without casting specific aspersions on the work of McGee specifically &#8211; there will be plenty of litigation that&#8217;ll address those questions &#8211; perhaps the real answer is to have prosecutors and &#8220;experts&#8221; that flagrantly bugger justice start serving some of the time they rip from the lives of the innocent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Michael Hansen was freed last month after six years in prison for a murder he didn&#8217;t commit.
