{"id":10943,"date":"2010-05-18T06:39:48","date_gmt":"2010-05-18T11:39:48","guid":{"rendered":"http:\/\/www.shotinthedark.info\/wp\/?p=10943"},"modified":"2010-05-18T06:39:48","modified_gmt":"2010-05-18T11:39:48","slug":"the-next-big-case","status":"publish","type":"post","link":"http:\/\/www.shotinthedark.info\/wp\/?p=10943","title":{"rendered":"The Next Big Case"},"content":{"rendered":"<p>Two years ago,, when the <em>Heller<\/em> case set the precedent that the Second Amendment right &#8220;of the people&#8221; meant &#8220;people&#8221; and not &#8220;the National Guard&#8221;, it left two questions:<\/p>\n<ol>\n<li>Would the case apply to the states?\u00a0 <em>Heller <\/em>referred to the federally-controlled &#8220;District of Columbia&#8221;; <em>McDonald, <\/em>which was argued last March and whose decision is due next month, should fix this.<\/li>\n<li>What are the &#8220;reasonable restrictions&#8221; that the court referred to?<\/li>\n<\/ol>\n<p>It&#8217;s an important question &#8211; because the orcs who oppose the human right of self-defense like to believe that human rights are commodities, and they are the dealers:<\/p>\n<blockquote><p>Mark Snyder, an amateur biathlete, wanted to buy a<br \/>\n.22-caliber bolt-action rifle for target shooting and figured the<br \/>\nprocess would take about a week. After nearly six weeks, six visits to<br \/>\npolice departments and $300 in fees, he secured his rifle.<\/p>\n<p>&#8220;I was not expecting a free ride,&#8221; said Mr. Snyder, 45, &#8220;but this is<br \/>\nan obstacle course they put in place.&#8221;<\/p><\/blockquote>\n<p>&#8220;Suuuuuure it&#8217;s your right &#8220;as a person&#8221;; now go get me a&#8230;<em>shrubbery<\/em>&#8220;.<\/p>\n<blockquote><p>The U.S. Supreme Court overturned the District of Columbia&#8217;s 32-year<br \/>\nban on handguns in 2008, a victory for the gun-rights lobby that<br \/>\nseemed to promise a more permissive era in America&#8217;s long tussle over<br \/>\ngun ownership. Since then, the city has crafted rules that are proving<br \/>\na new, powerful deterrent to residents who want to buy firearms.<\/p>\n<p>Legal gun owners must be registered by the city, a red flag for many<br \/>\nin the gun-rights community concerned that registration lists could be<br \/>\nused to confiscate firearms. The District limits the number of bullets<br \/>\na gun can hold and the type of firearm residents can buy.
